Terms and Conditions of Use

These Terms and Conditions of Use (hereinafter, the "T&C") govern access to and use of the chask™ platform (the "Service"), made available by CSK Technologies SpA ("chask", "We" or the "Company"), as well as the rights and obligations of the Users and of the Company. By creating an Account or using the Service, the User expressly accepts these T&C. If the User does not agree with their content, the User must refrain from using the Service.

• Account: Profile created by the User to access the Service.
• User: Natural person or legal entity that uses the Service.
• Content: Information, data, text, graphics and files that the User uploads or generates within the Service.
• Subscription Plans: Payment options that enable different features of the Service.
• Party(ies): The User and the Company jointly, or each of them separately.

chask™ is a personal assistance and automation platform that combines artificial intelligence and human operators to carry out tasks delegated by the User. The Service includes, but is not limited to, the creation of requests, payment management, sending of notifications and access to third-party AI algorithms (e.g., OpenAI, Anthropic) in accordance with the Privacy Policy.

The Service may only be used by persons over 18 years of age who have full legal capacity to enter into contracts. By registering, the User represents and warrants that they meet these requirements.

1. The User must provide truthful, complete and up-to-date information during registration.
2. The User is responsible for maintaining the confidentiality of their credentials and for all activities that occur under their Account.
3. In the event of unauthorized use, the User must notify chask™ immediately by writing to contact@chask.io.

The User may purchase Subscription Plans at the current rates published on the platform. Payments will be processed through Polar, Transbank or another designated provider. Non-payment will entitle chask™ to suspend or cancel access to the Service.

chask™ grants the User a limited, non-exclusive and non-transferable license to access and use the Service in accordance with these T&C. All intellectual property rights in the Service and its components (software, trademarks, algorithms, etc.) belong to chask™ or its licensors. The User may not copy, modify, decompile or perform any act that infringes such rights.

• Using the Service for unlawful purposes or purposes contrary to morality.
• Infringing the rights of third parties or sending defamatory content.
• Introducing malware or spam, or reverse engineering the Service.
• Performing scraping or data mining without express authorization.

The User may connect third-party artificial intelligence assistants (for example, Claude or ChatGPT) to the Service through the chask™ Model Context Protocol (MCP) server. In doing so:

• The assistant acts on behalf of the User and with the User’s same permissions. The actions that the User requests or authorizes are deemed to have been performed by the User, who is responsible for reviewing and confirming them.
• The assistant is a third-party service that the User contracts on their own. chask™ does not control and is not responsible for its operation, its responses or the processing of data by its provider, which is governed by that provider’s terms and privacy policy.
• The prohibited uses in section SEVENTH also apply to use of the Service through an assistant, including automated use to extract data in bulk.
• The User may revoke the connection at any time from their assistant. chask™ may suspend a connection that breaches these T&C or puts the security of the Service at risk.

chask™ will make reasonable efforts to keep the Service available 24 hours a day. However, the User acknowledges that interruptions may occur due to maintenance, third-party failures or force majeure events.

To the extent permitted by law, chask™ will not be liable for indirect damages, lost profits or loss of data arising from the use of or inability to use the Service. The total liability of chask™ will be limited to the amount actually paid by the User in the 12 months prior to the event giving rise to the claim.

The User may cancel their Account at any time from the settings section. chask™ may suspend or cancel the User’s Account in the event of a breach of these T&C, with prior notice where possible.

The Company reserves the right to modify these T&C at any time. Changes will be communicated to the User by email or through the Service. Continued use of the Service after notification will constitute acceptance of the new T&C.

These T&C will be governed by and construed in accordance with the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of justice of the city of Santiago.
